Intellectual Property Rights

  1. All intellectual property rights related to EduFund and its content (including copyrights, database rights, registered or unregistered trademarks, trade names, designs, and other intellectual property rights) are vested in, or licensed by, EduFund. Users are allowed to utilize the application tracker feature on EduFund for personal use. However, no material on the site can be extracted or reproduced without explicit permission. Any printouts or downloads made from the application tracker must maintain all copyright and proprietary notices.
  2. Our content includes any information or other material found on or via the Site, including text, databases, graphics, videos, software, and all other features found on or via the Site.
  3. "Any section of EduFund website or its content cannot be altered, duplicated, distributed, reproduced, stored on any other website, or used for commercial purposes without prior written consent from EduFund."

  1. Access to the EduFund website is available to anyone using a web browser and an internet connection. While certain functionalities might require an application for financial support, the EduFund platform does not require funding for general access.   2. We try to make the Site available at all times, but, of course, due to the inherent nature of online and Internet-based services, we cannot guarantee this.
  3. We do not warrant that your access to the Site will be uninterrupted, unrestricted, timely, secure, and error-free and we do not make any promises about the availability or accessibility of the Site or promise that your access to the Site, the content on it or the services we provide will be delivered uninterrupted, in a timely manner or error-free (and we may suspend, restrict or terminate your access to the Site at any time), or that the Site and the server are free of computer viruses or other harmful applications. Any content downloaded from EduFund is at your own risk, and we are not liable for any damage to your computer system or loss of data resulting from such downloads.
      • We're not liable for any indirect, consequential, or special losses,
      • including financial loss, data loss, missed opportunities, or damage to goodwill or reputation, whether such losses are direct or indirect.
    • If we are found to be liable, our total liability in respect of all claims made against us in connection with these Terms (other than those mentioned in paragraph 5.5 shall be limited to USD 100.

Miscellaneous

  1. Please be respectful when talking to our customer service specialists via email communication. If your email is abusive or offensive, our customer service specialists have the right to end the relevant communication immediately.
  2. A record of each email will be held indefinitely and may be used by us (i) when looking into your application; and/or (ii) for quality purposes (including, but not limited to, when you contact us using other methods or purpose set out in these Terms), in each instance in accordance with our Privacy Policy. Compensation

  1. You agree to only use the Site in accordance with these Terms. You agree that you will compensate us (and our employees, officers, agents, and suppliers) in full for any damages, losses, costs, and expenses, including reasonable legal fees we incur that arise out of or in connection with any breach of these Terms by you (including any actions you take which disrupt access to and/or the functioning of the Site) or any liability we incur as a result of the use of the Site by you.
  2. General Prohibitions on Access and Use of the Site:
    You may use the Site only for lawful purposes and you may not use the Site:
    • In any way that breaches any applicable local, national, or international law or regulation;
    • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
    • For the purpose of harming or attempting to harm minors in any way; or

Any changes will take effect 7 days after the date on which we post the modified terms If you continue to use the Site after that period has expired, it means that you accept any such changes.

  6. We will not be responsible for any breach of these Terms or otherwise for any delay or failure in processing your application for loan or service where such breach, delay or failure is attributable to you and/or any third party or is otherwise caused by circumstances beyond our control.
  7. Any agreement between us is made for the benefit of you and EduFund and, except unless expressly stated, is not intended to benefit or be enforceable, by anyone else.
  8. We aim to at all times provide you with an excellent standard of service. If for any reason you are unhappy with our service please contact us at applications@edufund.fund and we will aim to resolve your complaint as soon as possible.
  9. These Terms shall be governed by and construed in accordance with the laws applicable globally for funding and crowdfunding platforms. Each party involved, including EduFund and its users, irrevocably submits to the exclusive jurisdiction of the competent courts globally for resolving any disputes arising out of or in connection with these Terms.

Such content does not constitute financial, legal, or professional advice, and should not be relied upon as such. EduFund explicitly disclaims any liability or responsibility for reliance placed by any user, visitor, or individual who accesses the platform or becomes informed about its content.
  3. All fees or financial amounts mentioned on the EduFund platform are presented inclusive of any applicable taxes, including Value Added Tax (VAT), unless otherwise expressly stated.
  4. Before engaging in any financial arrangements or transactions facilitated by EduFund, we strongly advise users to independently verify all information provided by the service provider, lender, or any other party involved. It is recommended that users conduct thorough inquiries, due diligence, and assessments regarding the offered services, products, or opportunities and the respective provider or institution before finalizing any commitment or transaction.

Our Liability

  1. Subject to paragraph 5 Under these terms, EduFund shall not be held responsible or liable for:
    • Any losses related to your business, including but not limited to lost data, profits, revenue, business opportunities, goodwill, reputation, or business interruption. This includes losses that are not reasonably foreseeable.
    • Any data or information uploaded by applicants, including content posted, uploaded, or published on the EduFund website.
    • Any prevention or delay in complying with obligations under these terms and conditions due to actions or inactions by you or events/circumstances beyond EduFund's reasonable control.
  2. If we are found to be liable, our liability to you or to any third party shall be as set out in paragraph 5 of these Terms.

Changes to the Site

We aim to update the Site regularly and may change the content at any time. If the need arises, we may suspend access to the Site, or close it indefinitely. Any of the material on the Site may be out of date at any given time, and we are under no obligation to update such material.

  1. Upon submitting your data to the EduFund Site and agreeing to these Terms, you hereby consent to be automatically registered as a member of EduFund. You retain the option to unsubscribe from this service at any time, following the guidelines outlined below.
  2. You are solely responsible for any information and documents submitted by you to the Site. You warrant that all data and documents provided by you are complete, accurate, up-to-date, and not misleading or likely to deceive and you must update your account promptly with any changes to such details.
  3. When registering for EduFund, you will be required to generate confidential or logging details exclusive to your account. You are accountable for maintaining the confidentiality of those details and refraining from sharing them with any third party. You are liable for all activities and communications carried out or initiated using your credentials or logging details. In the event of any knowledge or suspicion regarding unauthorized access to your account, you must promptly inform EduFund. EduFund bears no responsibility or liability for any loss or damage resulting from failure to adhere to these obligations.
  4. At EduFund, periodic access restrictions to specific sections or the entire platform may be imposed, applicable to registered users. We retain the right to deactivate any user identification code or password, whether self-selected or provided by us, at our discretion. This action may be taken if, in our assessment, you have violated any provisions outlined in these Terms of Use if we suspect compromise of your user identification, or if there is perceived security jeopardy associated with the use of the said identification. EduFund may also mandate credentials or logging details changes or suspend your EduFund account as deemed necessary.
  5. You acknowledge and agree to indemnify EduFund, in entirety, for any incurred losses, liabilities, expenses (including legal expenses), damages assigned to EduFund by a court's judgment, or settlements made by EduFund. This indemnification applies to any claims brought against EduFund by third parties, to the extent that such claims are linked to activities conducted through your account.

Suspension and Cancellation

  1. Without prejudice to any other remedy available to us under the Terms or at law, if you have breached, or we have justifiable reason to believe that you have breached or will breach these Terms, we may suspend or cancel your registration immediately at our reasonable discretion.
  2. You may cancel your registration at any time by informing us by email sent to applications@edufund.fund If you do so, you must stop using the Site immediately.
  3. For the avoidance of doubt, on cancellation of your registration, for any reason, any paragraphs of these Terms which expressly or by implication have effect after termination shall continue in full force and effect.
  4. Cancellation or suspension of your registration or access to EduFund will not affect the rights or obligations previously accrued under these Terms by either party.
  5. We retain the right to remove your account and any associated personal data or information from EduFund if your account remains inactive for a continuous period of 36 months.
  6. Loan approvals are contingent upon Edufund's discretion to seek additional information, address concerns, or identify any disparities in the documentation provided by applicants. In such instances, EduFund reserves the right to require supplementary details, modify the loan amount, or potentially reject the finance request if deemed unsatisfactory
